1.2.2 may create a liability or risk for the user; and/or
1.2.3 may compel the user to indemnify the third party or the Company; and/or
1.2.4 serves as an acknowledgement, by the user, of a fact.

If there are any provisions in these Terms and Conditions that the user does not understand, please contact info@tripplegroup.co.za as it is the responsibility of the user to request an explanation should there be any of the Terms and Conditions which are not clearly understood by him/her prior to accepting the Terms and Conditions or continuing making use of our website or online systems.

Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or the Company in terms of the CPA.

The use of the Website is subject to the Terms and Conditions contained herein. By using this Website or any of our group branded websites in any manner, the user shall be deemed to have accepted all the Terms and Conditions unconditionally. The user may not use this Website in any way if the user does not unconditionally agree to all the Terms and Conditions.
By making use of our website/online-store/social media and/or purchasing items from us, the user engages our “service” and agrees to be bound by the Terms and Conditions as contained herein, including those additional terms and conditions and policies referenced herein and/or available by highlight or hyperlink. These Terms and Conditions will apply to all users of the site, including but not limited to users who are browsers, customers, contributors, vendors and/or merchants of content.

By agreeing to these Terms and Conditions, the user confirms that he/she is at least the age of majority in South Africa and has given us consent to allow any of the user’s minor dependents to use this site.

None of our products may be used for any illegal/unauthorized purpose nor may the user violate any laws in South Africa (including but not limited to copyright laws).

The user acknowledges and agrees that we provide access to such tools ”as is” and “as available” without any representations/warranties/conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by user of optional tools offered through the site is entirely at the user’s own risk and discretion. It is the user’s responsibility to ensure that the user is familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

The Terms and Conditions are effective unless and until terminated by either the user or us. The user may terminate these Terms and Conditions at any time by notifying us that he/she no longer wishes to use our services, or when ceasing to use our site.

If in our sole judgment the user fails, or we suspect that the user has failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and the user will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our services (or any part thereof).
1.25 Specials, pictures, description & newsletter:

Upon registering or placing an online order, the Customer will opt-in to our newsletter automatically and may unsubscribe from the newsletter at any time.

Tripple Hydro Energy (Pty) Ltd reserves the right to cancel any special or order without prior notice. Pictures may vary from products supplied and prices and specifications are subject to change without notice.

Tripple Hydro Energy (Pty) Ltd cannot be held responsible for any damage or loss as a result of incorrect product information provided.

2. Shipping & Payment Policy:
2.1 Telephone calls & the placing of orders:
To enable us to improve customer experience, boost agent productivity, evaluate agent performance and resolve disputes, all calls will be recorded.

2.2 Price changes:

All prices are subject to change without prior notice as and when required and are linked to changes in the Rand Dollar exchange rate.

We shall not be liable to the user or to any third-party for any modification, price change, suspension or discontinuance of the service.
2.3 Stock/products:

As our web site has a large quantity of available products, updates are run every 48 hours. As such, it might happen that items which are shown to be in stock can be out of stock. In such an event, we will immediately inform you of the expected delivery time as soon as this information becomes available. Based on this information you may elect to wait for the stock to arrive or cancel your order by requesting a refund. However, we endeavor to put all our resources together to prevent such an unfortunate situation from arising.

However, the customer must take note that the products or services with limited quantities are subject to return or exchange only according to our Return Policy.

We reserve the right, but are not obligated to, to limit the sales of our products or Services to any person, geographic region or jurisdiction. This right might be exercised on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.

Quotation or orders are valid for 24-hours or until stock lasts. Items are sold on a first-come-first-served basis only.

We reserve the right to refuse any order placed by the customer with us. In our sole discretion we may, cancel/limit quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
2.6 General order information:

Orders are processed from date on which the payment reflects in our bank account (during business hours).

Weekends and public holidays are not considered to be working days.

All orders received prior to 12:00 will be processed immediately and dispatched the following working day.

All orders received after 12:00 will be processed the next day and dispatched on the following working day.

Prices on the website will not be discounted by any percentage (%) when a customer pays via EFT or Cash Deposit or any other method.
2.8 Shipment method:

Any Courier option displayed as an option within our online store/s or as contracted with Tripple Hydro Energy (Pty) Ltd from time to time. All quotations exclude insurance as standard selection.

SAME DAY COLLECTION AT WAREHOUSE. Same day collection from our Warehouses in Cape Town, Johannesburg, Port Elizabeth and or Durban on selected Products. Payment for any order must be made upfront and must reflect in our account before we process the order. Please confirm if your selected item is available for same day collection at our warehouses as not all warehouses allow end user collections.

Use Own Courier: Customer will arrange for collection by appointing own courier and is responsible for any insurance applicable to such courier services. Tripple Hydro Energy (Pty) Ltd will not be liable for any claims of whatsoever nature.

Couriers are ordered as economy road fright. If the customer prefers delivery by any other courier or next day delivery is required, an additional cost will be applied and would be for the account of the client. Please inform us timorously hereof.

Courier costs include handling and packaging fees as well as postage costs. Handling fees are fixed, but the transport fee may vary according to the weight and dimensions of the items as ordered. It is recommended that the customer group all items in 1 (one) order in order to minimise the courier costs. Tripple Hydro Energy (Pty) Ltd is unable to group 2 (two) or more distinct orders which were placed separately as one parcel / delivery.

Packages are dispatched at the Customer’s own risk, but special care will be taken to protect objects that are fragile. Boxes and items ordered are packaged in such a way as to minimize the possibility of damage.
2.9 Delivery insurance:
To ensure that your items are protected from any loss during delivery, an additional Shipping Insurance option is provided but not necessary as Free Delivery insurance up to R10 000,00 is included. This Insurance is 1.5% of the value of your total order. Please advise if you do not wish to choose this option.
2.10 General delivery info:

Our service includes delivery via Door to Door delivery by courier and not delivery to Postal Boxes.
-
Deliveries will normally be made from Monday to Friday, between 08:00 and 17:00 (public holidays would be an exception and is dependent on the courier company schedule).
-
No tracking numbers will be supplied to items dispatched directly from the warehouse to customers depending the area, as deliveries will be made by in-house drivers in some instances.
-
Our couriers don’t give exact delivery times and will deliver between 8 am and 5 pm, Monday to Friday.
-
The Customer’s contact number will be provided to the courier company and they will contact you to make the necessary arrangements for the delivery of the goods as our couriers require someone to be at the address provided to accept the delivery.
-
Should no one accept the delivery first time round, a second delivery attempt will be arranged at an additional charge of R99-00, after the second failed attempt the courier company will return the goods to the Company.
2.11 International orders:

International clients may arrange for a courier service to collect from us once an arrangement has been made as we do not currently deliver outside the borders of the RSA.
-
Tripple Hydro Energy (Pty) Ltd is not a registered exporter and thus cannot deliver goods outside the borders of the RSA.

All invoices will carry a charge of 14% VAT.
Return Policy
3. Return policy:
3.1 General:
3.1.1 It is the responsibility of the customer to ensure that the product ordered is suitable for their needs and that the specifications of products meet their requirements prior to the placing orders as Tripple Hydro Energy (Pty) Ltd does not sell products on a trial basis.
3.1.2 No goods can be returned after 7 (seven) days or will be refunded if opened. Products returned must be undamaged, unused and in the original packaging together with the original labels still attached. No items will be refunded which have been build up or which have been modified any way.
3.1.3 The item being returned must be returned to Tripple Hydro Energy (Pty) Ltd at 9 Rand Street, George, Western Cape, South Africa and not the manufacturer.
3.1.4 The Customer will be responsible for paying the courier costs for items being returned. Courier costs are non-refundable and if a refund is approved, the cost of shipping will be deducted from the refund.
3.1.5 In certain instances, only partial refunds will be made, for instance, but not limited to the following:
3.1.5.1 Any item not in its original condition which was damaged or is missing parts for any reason not due to Tripple Group Hydro Energy (Pty) Ltd’s error;
3.1.5.2 Any item returned after more than 7 (seven) days from date of delivery.

It may take 7 (seven) to 14 (fourteen) business days for the funds to be processed back into your account.

In the event of the incorrect product being delivered by our suppliers (not the product ordered by the customer), please contact our customer service on email orders@tripplegroup.co.za to notify us. We will arrange for the incorrect product to be collected and the correct product to be delivered to the customer. The product should not be removed from the original packaging and should be in unused condition.

No promotional items will be refunded, only regular priced items.

Items will only be replaced if they are damaged or defective, according to manufacturer warrenty.
-
Items returned will be subject to a 15% handling fee.
3.2 Dead on Arrival (DOA):
3.2.1 Please contact us within 48-hours (forty eight) via email on orders@tripplegroup.co.za if the product delivered has been damaged en-route or if the product is DOA and we will arrange for the collection of the goods. It is the customer’s responsibility to thoroughly check the products and advise us if there is any fault or damage. The product will then be returned to our supplier and tested to confirm the defect or fault. We will inform the customer via email of the approval or rejection of the request for a refund. If the refund has been approved, the product will either be repaired or returned, a replacement will be provided (depending on the warranty provided by the manufacturer) or a credit will be applied to your credit card or original method of payment or by means of an Electronic Transfer if the payment gateway restrict any reverse processed payments at such time that it is actioned.
3.2.2 If the refund was approved but not received, the customer is requested to check their bank account to ensure that the payment is not reflecting and any proof provided when requested by the company. When a credit card refund, the customer is requested to contact their credit card merchant as it might take a few days for the refund to reflect in the bank account. After this, the customer is requested to contact their bank as the processing of refund might take a few days to be posted by the bank. Should the customer have done all the above and the refund has still not been received, please send us an email to orders@tripplegroup.co.za .
3.2.3 DAMAGED OR FAULTY GOODS MUST BE REPORTED IN WRITING WITHIN 48-HOURS AFTER DELIVERY THEREOF BY THE COURIER.
3.2.4 Tripple Hydro Energy (Pty) Ltd reserves the right to levy an additional handling/re-stocking fee of up to 50% of the product value on open/new items returned.
3.2.5 Tripple Hydro Energy (Pty) is in agreement with its suppliers with regards to returns in terms of Section 55 of the CPA (Consumer Protection Act) and it shall apply mutatis mutandis to the customer, having the effect that such warranty terms apply directly between the customer and the supplier of the product which the customer wishes to return. Tripple Hydro Energy (Pty) only acts as an intermediately between the customer and the product supplier or manufacturer.
3.2.6 Products which have been opened and used shall not be accepted for returns. All return products must have an intact barcode, serial number or identification number to be eligible for returns. The customer shall be liable for all cost relating to the return of the products, including but not limited to the courier cost. Tripple Hydro Energy (Pty) may elect to charge a handling fee on returns. All risk of damage, theft or loss of the items being returned shall rest with the customer.
3.3 Cooling off Period:
The customer will be entitled to a cooling-off period of 7 days from date of the online transaction as contained in section 44 of the ECT Act. Should the customer cancel the transaction he/she agrees to a handling fee of 15% of the value of the transaction and the cost of the courier service to return the goods to the company or manufacturer.
3.4 Warranty, limitation of liabilities and indemnification:
3.4.1 All warranties are covered by the manufacturers and dealt with in the same way as if this item is purchased from an authorised retail outlet. The warranty will lapse if the serial number label is missing, damaged or has been tampered with.

All warranties lay with the manufacture/distributors of the products and not with Tripple Hydro Energy (Pty) Ltd.

All goods sold by Tripple Hydro Energy (Pty) Ltd carry a minimum of 1-year Carry-in warranty with the manufacturer and is conditional to the manufacturer’s terms & conditions of use. The complete pump range offered by Tripple Hydro Energy (Pty) Ltd carries a 2 year carry-in manufacturer’s warranty and is conditional to the manufacturer’s terms & conditions of use.

Customers who wish to make a warranty claim must comply with the manufacturer’s instructions and warranty procedures.

The manufacturer/importer’s obligation is limited under the warranty to repairing/replacing, at the discretion of the manufacturer/importer, any part(s) which was properly installed, used and maintained and which has under factory examination proved to be defective in materials/workmanship within 1 (one) year from the date of delivery to the customer.

Warranties do not apply to any part/component which deteriorates under normal use and circumstances or which has a normal life inherently shorter than the warranty stated. For example, but not limited to, filters which are warranted for 7 (seven) days.

No warranty shall be in effect for any item which has been subjected to negligence, accident, misuse or has been modified or repaired by any person other than the manufacturer, unless written permission has been grated to that effect.

This warrant replaces all other warranties of quality and there are no other warranties, statutory, oral, written or implied.

Implied warranties of fitness for purpose and merchantability are excluded.

In no event shall Tripple Hydro Energy (Pty) Ltd, nor it’s directors, partners and suppliers be liable for incidental, special, indirect or consequential damages nor damages arising out of the delay in shipment or production.

We do not guarantee, represent or warrant that the user’s use of our service will be timely, uninterrupted, secure or error-free.

We cannot warrant that the results that may be obtained from the use of the website services will be accurate or reliable at all times.

The user agrees that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to the user.

The user expressly agrees that the use of, or inability to use, the service is at the user’s sole risk. The service and all products and services delivered through the service are (except as expressly stated by us) provided 'as is' and 'as available', without any warranties, conditions or representation of any kind, either implied or express, including all implied warranties or durability, conditions of merchantability, fitness for a particular purpose, merchantable quality, title, and non-infringement.

As our web site has a large quantity of available products, updates are run every 48 hours. As such, it might happen that items which are shown to be in stock can be out of stock. We reserve the right to refuse any order placed by the customer with us. In our sole discretion we may, cancel/limit quantities purchased per person, per household or per order. Any Courier option displayed as an option within our online store/s or as contracted with Tripple Hydro Energy (Pty) Ltd from time to time. All quotations exclude insurance as standard selection.

SAME DAY COLLECTION AT WAREHOUSE. Same day collection from our Warehouses in Cape Town, Johannesburg, Port Elizabeth and or Durban on selected Products. Payment for any order must be made upfront and must reflect in our account before we process the order. Please confirm if your selected item is available for same day collection at our warehouses as not all warehouses allow end user collections.

Use Own Courier: Customer will arrange for collection by appointing own courier and is responsible for any insurance applicable to such courier services. Tripple Hydro Energy (Pty) Ltd will not be liable for any claims of whatsoever nature.

Couriers are ordered as economy road fright. If the customer prefers delivery by any other courier or next day delivery is required, an additional cost will be applied and would be for the account of the client. Please inform us timorously hereof.

Courier costs include handling and packaging fees as well as postage costs. Handling fees are fixed, but the transport fee may vary according to the weight and dimensions of the items as ordered. It is recommended that the customer group all items in 1 (one) order in order to minimise the courier costs. Tripple Hydro Energy (Pty) Ltd is unable to group 2 (two) or more distinct orders which were placed separately as one parcel / delivery.

Packages are dispatched at the Customer’s own risk, but special care will be taken to protect objects that are fragile. Boxes and items ordered are packaged in such a way as to minimize the possibility of damage.
2.9 Delivery insurance:
To ensure that your items are protected from any loss during delivery, an additional Shipping Insurance option is provided but not necessary as Free Delivery insurance up to R10 000,00 is included. This Insurance is 1.5% of the value of your total order. Please advise if you do not wish to choose this option.
2.10 General delivery info:

Our service includes delivery via Door to Door delivery by courier and not delivery to Postal Boxes.

Deliveries will normally be made from Monday to Friday, between 08:00 and 17:00 (public holidays would be an exception and is dependent on the courier company schedule).

No tracking numbers will be supplied to items dispatched directly from the warehouse to customers depending the area, as deliveries will be made by in-house drivers in some instances.

Our couriers don’t give exact delivery times and will deliver between 8 am and 5 pm, Monday to Friday.

The Customer’s contact number will be provided to the courier company and they will contact you to make the necessary arrangements for the delivery of the goods as our couriers require someone to be at the address provided to accept the delivery.

Should no one accept the delivery first time round, a second delivery attempt will be arranged at an additional charge of R99-00, after the second failed attempt the courier company will return the goods to the Company.
2.11 International orders:

International clients may arrange for a courier service to collect from us once an arrangement has been made as we do not currently deliver outside the borders of the RSA.

Tripple Hydro Energy (Pty) Ltd is not a registered exporter and thus cannot deliver goods outside the borders of the RSA.
All invoices will carry a charge of 14% VAT.
